TASMANIAN PLANNING SCHEME - SOUTHERN MIDLANDS COUNCIL
The Tasmanian Planning Scheme is a single set of planning rules that will apply consistently across Tasmania through the State Planning Provisions (SPPs). The SPPs are applied in each Council through the Local Provisions Schedule (LPS), comprising of zoning maps, overlays and locally unique planning rules.
The Tasmanian Planning Scheme – Southern Midlands (the combination of the Local Provisions Schedule and the State Planning Provisions formally came into effect for Southern Midlands Local Government area on 15 June 2022 and replaced the former Southern Midlands Interim Planning Scheme 2015.

PlanBuild Tasmania
PlanBuild is an online platform developed by the State Government to centralise information about development in Tasmania. It is an alternative way to access planning information for a specific property.

CROWN LAND
Where proposed developments require the use of Crown land, proponents are required, under Section 52(1B) of the Land Use Planning and Approvals Act 1993, to include with the planning permit to Council the consent of the Minister responsible for the administration of the Crown land.
If your proposed development requires the use of Crown Land, you will need to obtain consent in accordance with the Act from the appropriate State Government department.

Council Building Surveying Services
New - Council Building Surveying Service (Class 7b & 10a only)
Council provides Building Surveying services for Class 10a structures (garages / sheds / carports or like) and Class 7b structures (farm buildings), or you can engage a Private Building Surveyor.

The Building Act 2016 consists of 4 Categories which are:
- Category 1 - Low Risk Building Work,
- Category 2 - Low Risk Building Work,
- Category 3 - Notifiable Work by a Building Surveyor,
- Category 4 - Work that requires a Permit.
Please contact your designer or building surveyor for clarification which category your building works falls within.
How can I submit my application?
An application and detailed documents can be submitted by:
- In person to Council Offices, 71 High Street Oatlands Tas 7120 or 85 Main Street, Kempton Tas 7030;
- Email the application IN ITS ENTIRETY IN A SINGLE PDF FILE (you may need to reduce your file size) to mail@southernmidlands.tas.gov.au
- Lodge your documents via our File Upload Portal. You will need to enter your Full Name, Email address and an optional message and attach your documents and then select submit. It is requested that you also add a contact number to the message section in case we need to contact you about your upload. If you are submitting Development/Building Applications, please read below information first.

Single Dwellings and/or Secondary Residence
Are you planning to build a single dwelling and/or a secondary residence (e.g. granny flat or studio)?
Before you start works you must apply to Council with your proposed plans.
A single dwelling and/or secondary residence may be eligible for the Planning Authority to issue a No Permit Required certificate. This means your plans have been assessed and do not need a planning permit.
You must apply to find out if your single dwelling and/or secondary residence design proposal is eligible for ‘No Permit Required’.
WHAT DO I NEED FOR AN APPLICATION?
The No Permit Required application must consist of:
Completed planning application form
Plans/drawings of your proposal (a scaled site plan and elevations of the building)
Current copy of titles, including the schedule of easements, if any.
Fee payment of $150
Download the planning application form and email it, along with your plans/design drawings and the titles to mail@southernmidlands.tas.gov.au
WHAT HAPPENS NEXT?
Once you lodge your completed application and the assessment fees have been paid in full, a Planning Officer will be in contact with you when your application is ready for assessment.,
Your No Permit Required application will be assessed against the applicable provisions of the planning scheme for the Southern Midlands municipality. This assessment may take up to 10 business days.
WHAT IF MY APPLICATION DOESN’T QUALIFY?
Sometimes a single dwelling and/or secondary residence proposals require a planning permit. If your No Permit Required application does not qualify for the ‘No Permit Required’ certificate, your application will automatically be converted to a planning permit application. If this happens to your application, a Planning Officer will be in contact with you to discuss the assessment of your application and associated fees.
THINGS TO CONSIDER WITH A NO PERMIT REQUIRED APPLICATION
Dwellings
A dwelling is a building, or part of a building, used as a self-contained residence and which includes food preparation facilities, a bath or shower, laundry facilities, a toilet and sink, and any outbuilding and works normally forming part of a dwelling.
A single dwelling is one dwelling on a lot on which no other dwelling is situated, or a dwelling and an ancillary dwelling on a lot on which no other dwelling is situated.
A secondary residence is an additional residence which is self-contained and:
has a gross floor area not more than 60m²;
is appurtenant to a single dwelling;
shares with the single dwelling access and parking, and water, sewerage, gas, electricity and telecommunications connections and meters; and
may include laundry facilities
ZONING
A single dwelling and/or a secondary residence in the General Residential zone, Inner Residential zone, Low Density Residential zone, Rural Living zone and Village zone may be eligible for a No Permit Required certificate.

SUBMITTING PLANS
The plans/design drawings attached to your application should be professionally drawn. However, if you can competently draw plans to a reasonable scale (1:100, 1:200), a sketch plan (site plan and elevations) may be accepted as part of your application.
PROPERTY TITLES
The current copy of titles can be accessed through the TheList website.

Can I build a Shed!!
An owner builder can build a 18sm timber structure non prefab shed or a 36sm prefab steel shed without a building permit. These types of building work still require a planning permit unless it is exempt under the scheme. For further information visit the Department of Justice and check the Guide to the Building Act 2016 or information is also on the Directors Specified List.

Lodging your Regulatory documents and applications electronically.
Currently council has two methods of lodging documents and applications electronically.

Signage
Business Signage
Most new signs or changes to existing business signage within Southern Midlands require planning approval under the Tasmanian Planning Scheme C1.0 Signs Code; unless explicitly deemed exempt.
The purpose of the Signs code is:
- To provide for the clear advertising of business and community activities.
- To provide for well-designed signs that are compatible with the visual amenity of the surrounding area.
- To ensure signage does not disrupt or compromise safety and efficiency of vehicular or pedestrian movement

Under the Tasmanian Planning Scheme – A sign is exempt from requiring a planning permit only if all of the following apply:
- it is not erected more than 8 weeks before the polling date — for the 2026 election, not before 10 August 2026
it does not encroach on any road or other public land, meaning land owned or managed by the Crown, a State Authority or a Council
it has a maximum area of 1.5m²
it is removed within 7 days after the polling date — for the 2026 election, before 4 November 2026
Signs that don’t meet all four requirements need planning approval from Council. Breaching the planning scheme may result in an infringement notice of 15 penalty units for an individual or 75 penalty units for a corporation.
Council may also give notice to the person who placed a sign, or to the owner of the land it’s on, requiring its removal, and may remove the sign and recover the costs of doing so. See section 48 of the Land Use Planning and Approvals Act 1993.
