Nuisances

You must ensure that whilst you are carrying out building work under a building and plumbing permit you do not cause any of the following nuisances as stated under the Building Regulations 2004:

 Prevention of nuisances

 A person must not allow dirt, dust, fumes, noise, smoke, building materials, sewage or concentrations of water which are caused by, or occur in the course of, building work to become -

  • A public health risk; or
  • A nuisance for an owner, occupier or user of adjoining land.

The following penalties are applicable (however Council can also issue you with an infringement fine).

Penalty:

Fine not exceeding 20 penalty units and a daily fine not exceeding 10 penalty units for each day during which the offence continues.
